Terms of Use

The agreement between you and Spark.

Last updated 5 November 2026

1. About these terms

These Terms of Use ("Terms") apply to the Spark app, Spark Pro, this website and related services ("Spark"), offered by Inner Craft B.V., a private limited company (besloten vennootschap) based in the Netherlands ("we", "us"). By creating an account or using Spark you agree to these Terms. Please also read our Privacy policy.

2. Who can use Spark

You must be at least 13 years old to use Spark. If you are under 16, or under the age of majority where you live, you may only use Spark with the permission of a parent or guardian, who accepts these Terms on your behalf. Purchases of Spark Pro by minors are subject to Apple's Family Sharing and Ask to Buy settings.

3. Your account

You sign in with a one-time code sent to your email address. Keep your email account secure, because anyone with access to it can sign in to Spark. You are responsible for activity under your account and must tell us straight away at the support address below if you think it has been accessed without permission. One person may hold one account. You can delete your account at any time in the app.

4. What Spark is, and what it is not

Spark helps you plan and track habits, reflect in a journal, check in with your mood, meditate, read short lessons and share habits with people you invite. Spark is a self-improvement tool. It is not a medical device and does not provide medical, psychological, nutritional or other professional advice, diagnosis or treatment. Content in Learn and replies from Spark AI are general information. If you are worried about your physical or mental health, contact a qualified professional or, in an emergency, call 112.

5. Spark Free and Spark Pro

Spark Free is free of charge and includes one active habit, check-ins, streaks, planned rest and pauses, all 16 badges, the mood check-in and graph, the journal, meditation and Your Circle.

Spark Pro is an optional paid subscription that adds unlimited habits, Spark AI, Insights and every lesson in Learn. Features may change over time; we will not remove core features you have paid for during your current subscription period without offering a fair alternative or a pro-rata refund where the law requires it.

6. Subscriptions, trials and payment

  • Purchase through Apple. Spark Pro is sold as an auto-renewable subscription through the Apple App Store. Payment is charged to your Apple ID at confirmation of purchase. Apple's terms and payment conditions apply.
  • Prices. Current prices are shown in the app before you buy, in your local currency and including VAT where applicable. At the time of writing they are €14,99 per month or €113,99 per year in the Netherlands.
  • Free trial. If a free trial is offered, it is available once per Apple ID. Unless you cancel at least 24 hours before the trial ends, it converts into a paid subscription and your Apple ID is charged.
  • Automatic renewal. Subscriptions renew automatically for the same period unless you turn off auto-renew at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours before the end of the period.
  • Cancelling. Manage or cancel your subscription on your iPhone in Settings → your name → Subscriptions. Pro stays active until the end of the period you paid for. Deleting the app or your Spark account does not cancel a subscription.
  • Refunds. Apple handles all payments and refunds. Request a refund at reportaproblem.apple.com. We cannot issue refunds for App Store purchases ourselves.
  • Price changes. If we change the price of a subscription, Apple informs you in advance and, where the law requires it, asks for your consent before the new price applies.

7. Right of withdrawal (EU consumers)

As an EU consumer you normally have 14 days to withdraw from an online purchase. For digital content and services that start immediately, you agree when buying through the App Store that Spark Pro starts straight away and acknowledge that your right of withdrawal ends once it has started, to the extent permitted by law. This does not affect Apple's own refund process or your statutory rights if Spark Pro does not work as described.

8. Your content

Content you create in Spark, such as habit names, journal entries and invitations, remains yours. You give us a limited, non-exclusive licence to store, process and display it only to provide Spark to you and, where you choose, to the people in your circle. You are responsible for what you share and must have the right to share it.

9. Your Circle and acceptable use

Your Circle lets you invite people, share habits and send cheers and nudges. Cheers and nudges are fixed messages chosen in the app; there is no free-text messaging. When using Spark you must not:

  • harass, threaten, intimidate or spam other people, or send excessive invitations or nudges;
  • impersonate anyone or create accounts for others without permission;
  • try to access other people's data or accounts, or probe, scan or test the security of Spark;
  • interfere with or overload the service, or use bots or automated means to access it;
  • copy, modify, reverse engineer or resell the app, except where the law expressly allows it;
  • use Spark for anything unlawful.

You can remove or block someone at any time. We may limit features, remove content or suspend accounts that break these rules.

10. Spark AI

Spark AI generates suggestions using artificial intelligence. Replies can be inaccurate or incomplete. Use your own judgement, and do not rely on Spark AI for medical, legal, financial or safety decisions. Do not enter sensitive information you do not want processed by our AI provider. Spark AI may have usage limits to keep the service fair and reliable.

11. Intellectual property

Spark, including the app, its design, name, logo, star, badges, artwork, lessons, sounds and website, is owned by us or our licensors and protected by intellectual property laws. We give you a personal, non-exclusive, non-transferable, revocable licence to use the app on Apple devices you own or control, in line with these Terms and the App Store Usage Rules. If you send us feedback or ideas, we may use them without obligation to you.

12. Availability and changes

We work to keep Spark available and secure, but we cannot guarantee it will always be uninterrupted, error-free or available on every device or iOS version. We may update, change or discontinue features. If we discontinue Spark Pro entirely, we will give reasonable notice. Reminders and notifications depend on iOS and your settings, so we cannot guarantee every notification is delivered.

13. Liability

We provide Spark with reasonable care and skill. To the extent permitted by law, we are not liable for indirect or consequential loss, loss of profits, or loss of data stored only on your device (such as your journal) when you remove the app or change phones without exporting it. Our total liability for any claim relating to Spark is limited to the amount you paid us for Spark Pro in the 12 months before the event giving rise to the claim, or €50 if you have not paid anything. These limits do not apply to liability that cannot be limited by law, such as damage caused by intent or gross negligence, and do not affect your statutory rights as a consumer.

14. Ending the agreement

You can stop using Spark and delete your account at any time. We may suspend or end your account if you seriously or repeatedly break these Terms, if required by law, or to protect other users. Where reasonable, we will tell you the reason and give you the chance to export your data first. Sections that by their nature should survive (such as intellectual property and liability) continue to apply.

15. Changes to these terms

We may update these Terms, for example when we add features or the law changes. If changes are significant, we will notify you in the app or by email at least 30 days before they take effect, unless a change is required sooner by law. If you do not agree, you can delete your account before the changes apply.

16. Apple App Store terms

These Terms are between you and us, not Apple. Apple is not responsible for Spark or its content and has no obligation to provide maintenance or support. If Spark fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price, if any; to the maximum extent permitted by law, Apple has no other warranty obligation. Apple is not responsible for any claims relating to Spark, including product liability, legal or regulatory compliance, consumer protection or intellectual property claims; we are responsible for these. You confirm that you are not located in a country subject to a US government embargo and are not on any US government list of prohibited parties. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. Apple's Licensed Application End User License Agreement applies where these Terms do not cover a topic.

17. General

If any part of these Terms is found invalid, the rest remains in force. Our failure to enforce a provision is not a waiver. You may not transfer your rights under these Terms without our consent; we may transfer them to a company that takes over Spark, as long as your rights are not reduced. These Terms, together with the Privacy policy, are the entire agreement between you and us about Spark.

18. Governing law and disputes

These Terms are governed by Dutch law. If you are a consumer living in another EU country, you also keep the protection of the mandatory laws of that country. If you have a complaint, please email info@sparkhabitapp.com first; we aim to respond within 5 working days and resolve it within 14. Disputes are submitted to the competent court in the Netherlands, unless the law gives you, as a consumer, the right to bring proceedings in the courts of your own country.
